The lessee declares on his honour that the premises, which are the subject of this contract, are rented to him solely as a temporary residence and for holidays, as part of a furnished seasonal rental, which may not exceed 90 days.
The rental period begins and ends at the times indicated in the special conditions of this rental contract. It may not be extended without the prior agreement of LAMY, which is accepted by the lessee.
A deposit of 25% is required to make this agreement firm and definitive. In any event, the balance of the rental price must be paid one month before taking possession of the rented premises. If the booking is made 15 days before arrival, the full rent will be required. No keys will be issued unless the balance has been paid.
On the day of arrival, the flat will be available from 4pm. The lessee must inform LAMY at least five days in advance of the approximate time of arrival and must give advance notice in the event of arrival outside the agency's opening hours.
At the end of the rental period, the lessee undertakes to return the keys to reception before 10am. If the keys are not returned at the specified time, the hirer will be charged for an extra day. Any key not returned will be invoiced at the replacement price. If the flat is not returned in a perfectly clean condition, the hirer will be billed for the cost of end-of-stay cleaning.
If payment is not made by the due date or if any clause of the contract is not fulfilled, the agreement will be terminated automatically eight days after formal notice has been served, and the lessee will be required to leave the rented premises by order of the interim relief judge.
The lessor undertakes to make the rented accommodation available to the lessee in accordance with the description and to comply with the obligations arising from this agreement. If the lessor fails to make the rented premises available, the lessee shall be liable to pay compensation equal to the rental loss suffered, unless the lessee agrees to replace the premises.
The lessee undertakes to take the rented premises in the condition in which they will be on arrival, as described in the description appended to this contract. On arrival, the tenant will check the accuracy of the inventory provided and must report any anomalies within 72 hours. Once this period has elapsed, the inventory will be deemed to be accurate and the rented premises will be considered to be in good rental condition.
The lessee undertakes to use the furniture and objects in the rented property for the purpose for which they are intended and in the location in which they are found, and formally refrains from transporting them outside the rented premises. He/she shall absolutely refrain from throwing into the washbasins, bidets, baths, sinks, WCs, etc. any objects likely to block the drains, failing which he/she shall be liable for the costs incurred in restoring these appliances to working order. The tenant undertakes to leave the premises and the furniture in a clean and tidy condition, to return the furniture and furnishings to their original position and to close the flat carefully.
The lessee must comply with the building's internal regulations, particularly with regard to noise and hanging laundry on the railings.
The lessee must allow any urgent work required to maintain the rented premises and common elements in good condition to be carried out.
Under penalty of termination, the lessee may not under any circumstances sublet or assign his rights under this lease. The lessee must live in the rented premises as a member of the bourgeoisie and may not, under any circumstances, store furniture there, with the exception of linen and small items.
Under no circumstances may the furnished accommodation be occupied by more people than indicated on the contract. Failing this, the contract may be terminated immediately or a supplement of 20% of the public price may be charged for each additional person.
Pets are only accepted with the express agreement of the agency and at an additional cost.
If the lessee defaults, LAMY may look for a new lessee. In this case, the defaulting tenant will be required to pay compensation equal to the rental loss suffered by the owner, i.e. the pro rata temporis amount of the period for which the tenant defaulted, and for which the premises were not re-let. The tenant's default entailing renunciation of the benefit of the stay, may be covered by a HOLIDAY CANCELLATION guarantee under the insurance conditions taken out by LAMY, the clauses of which are appended to the present contract.
The lessee is obliged to take out insurance with an insurance company against the risks of theft, fire and water damage, both for the rental risks and for the rented furniture, as well as against recourse by neighbours, and to provide proof of this at the request of LAMY or its agent.
Consequently, the latter decline all responsibility for the recourse that their insurance companies could exercise against the lessee in the event of a claim or in the event of theft in the rented premises and their annexes.
It is agreed between the signatories that LAMY and its principal are only bound by a best endeavours obligation with regard to any interruptions in the operation of the general services of the building, as well as those related to public services. Such failures may only lead to a reduction in the rent if LAMY or its principal is at fault.
All cancellations must be notified in writing. The full price of the stay is due to the agency, which reserves the right to recover the amounts due by all legal means. Any stay cut short or interrupted by the hirer will not entitle the hirer to any refund.
A security deposit must be paid when the keys are handed over by cheque in euros payable in France or by bank card by pre-authorisation (Visa, Mastercard/Eurocard) and will be cancelled once the tenant has left and the accommodation has been checked.
The security deposit will be reimbursed within 20 days of the return of the keys at the end of the rental period. This period will be extended if the refund of the security deposit requires the production of supporting documents such as bills for repairs, consumption, cleaning, etc. If the security deposit is insufficient, the lessee undertakes to pay the full amount.
The furniture and furnishings must not suffer any depreciation other than that resulting from the normal use for which they are intended. Those which, at the end of the present agreement, are missing or have been taken out of service, for any reason other than normal wear and tear, must be paid for by the lessee, after deduction of obsolescence, unless they are replaced with the consent of LAMY. This clause also applies to papers, hangings, carpets, the building in general, as well as the common areas if the building is co-owned. The following will be retained
a - The value of any missing, broken or cracked items, less any obsolescence.
b - The cost of washing or cleaning carpets, rugs, blankets, mattresses, bedding, etc. that have been stained.
In accordance with the law of 30 July 2003 on damage prevention and article L 125-5 of the Environmental Code, and in view of the ‘seasonal’ and temporary nature of the occupation of the property, Lamy provides the tenant with all the legal texts and decrees, a statement of risks for each commune and the updated risk zoning plans issued by the communes and the Savoie prefecture.
